General Conditions
Please read the following terms and conditions carefully. By signing up as a subscription to Newsconnection you agree with the following agreement. Inextricably linked to these general conditions, is the policy for acceptable use of Newsconnection.
Article 1 Definitions
1.1 The "Acceptance Date" is the date on which the subscriber through the website of Newsconnection sign up and accept this agreement.
1.2 The "Service" shall mean the access to usenet from Newsconnection .
1.3 "Subscriber" shall mean the natural person that subscribes at Newsconnection.
1.4 "Parties" are Newsconnection and subscriber.
Article 2 General
2.1 On all agreements, including future, between Newsconnection and subscriber, these general conditions shall apply, unless subscriber and Newsconnection have agreed otherwise in writing.
2.2 These general terms replace earlier by Newsconnection's terms and conditions.
2.3 All Newsconnection offers are without engagement and can be revoked within 7 days after such offer, unless subscribers and Newsconnection have agreed otherwise.
2.4 Newsconnection has the right to adjust the terms and conditions at all time. Changes will be done after notification or within 30 days after the notification. If the subscriber does not agree with this change, the subscriber should put this in writing within 30 days after the notification. In absence of a response from the subscriber the new conditions will enter in to force . Changes will be published on the website of Newsconnection.
2.5 With online signing in and accepting these terms and conditions the subscriber declares to be at least 18 years.
Article 3 Subscriptions
3.1 A subscription is completed by filling the registration form on the website of Newsconnection, or in any other manner specified by Newsconnection.
3.2 After receiving the notification and payment of the subscription Newsconnection gives the subscriber access to the service. The Newsconnection subscribers receive an email with the login information to access the service. Details of the costs and the contents of the service are available on the website of Newsconnection, www.newsconnection.co.uk
3.3 The agreement between Newsconnection and the subscriber takes place for a period of 30 days, 3 months, a half year or one year, unless the parties agree otherwise. A week before the end of this period Newsconnection will send an email to the subscriber where the subscriber is reminded when the period of the subscription is going to end. The subscriber has the option to extend the subscription without interruption. If the subscriber decides not to pay for an extension the subscription shall be automatically terminated.
3.4 If the subscriber neglect one or more of its obligations, including its financial obligations towards Newsconnection, Newsconnection has the right to terminate the subscription and / or access to the service with immediate effect.
3.5 Newsconnection has the right at all times, without reason, to refuse, suspend or terminate subscriptions.
Article 4 Fees
4.1 Unless otherwise agreed, to all agreements between Newsconnection and the subscriber, the Newsconnection handling fees and rates apply, which are stated on the website of Newsconnection.
4.2 Newsconnection has the right to change prices for its products or services. If possible, the subscriber receives a message of this, 10 days before the onset of the changes in writing (including email).
Article 5 Payment
5.1 Payments to Newsconnection are made via a prepaid system with the following payment options. iDEAL, Paypal, Carte Bleue, SMS or through a bank transfer. All these payments are completed before the period shall be fulfilled, the period shall run only after receipt of payment or extension adjacent to the current period.
Article 6 Guarantees & Liabilities
6.1 The Subscriber warrants that all information in any manner whatsoever provided to Newsconnection is complete, accurate and current.
6.2 The subscriber is obliged by Newsconnection obligations, instructions and restrictions.
6.3 The subscriber must handle in accordance with applicable laws and regulations and should behave properly as from a reasonable subscriber may be expected. Also, the subscriber when using the service must try as much as possible to prevent the interests of Newsconnection get violated.
6.4 It is the subscriber in any way disallowed to use the service for illegal acts, the commission of criminal acts and / or acts which are contrary to the Netiquette, or the rules of the Internet community.
6.5 Without the explicit permission of Newsconnection, the subscriber is not allowed to connect (parts of) a network or other users, whether or not within its organization, in any way to connect with (parts of) the service of Newsconnection.
6.6 Should the subscriber fail to comply with the preceding paragraphs of this article or Newsconnection has the suspect in this regard, it is Newsconnection entitled to take measures such as suspension of the obligation to provide the service. The subscriber in this case cannot rely on a refund of prepaid fees or damages.
Article 7 Retention & Completeness
7.1 Newsconnection does not guarantee retention or completion rates. The Newsconnection communicated retention and completion rates are estimates that are based on the current actual data.
7.2 If the Usenet posting volume increases or decreases Newsconnection can increase or decrease retention without notice.
Article 8 Copyright
8.1 Almost every country has copyright laws. Newsconnection cannot and does not review the information flowing through our system. When you become a Newsconnection subscriber, you are agreeing not to transfer or store copyrighted works on our system without the permission of the copyright holder.
Article 9 Controversial and Explicit material
9.1 Newsconnection is in no way responsible for the content of communications from the subscriber via the service of Newsconnection. Internet and Usenet are large communities and censorship is regarded as a serious crime. During use of the service, the subscriber can be exposed to materials that may be offensive to the subscriber. Examples include sexually explicit text and images, debates between advocates and opponents of certain religions, questionable political views and hateful statements.
9.2 Newsconnection will not tolerate in any way that subscribers are guilty of possessing or distributing child pornography in any form whatsoever. Newsconnection has the right in that case to deny the subscriber immediately access to its network and to end the subscription.
9.3 When communicating with people on the newsgroups, it is best to keep in mind that there are many other people that read what you post. Please consider the views and feelings of everyone who might read your posts and give them the same consideration and respect as you would like to receive yourself.
Article 10 Security & Privacy
10.1 With the agreement with the subscriber, Newsconnection takes the best effort to secure the service, but in case of insufficient security Newsconnection is not liable for any damages, which the subscriber or third parties suffer.
10.2 If the subscriber notes or suspects that a third party has access to his/here personal subscription without his/here consent, they have to notify Newsconnection by writing (including email). Not Newsconnection but the subscriber is at all times liable for any damages resulting from such improper use of the service.
10.3 The data of the subscriber listed in the records of Newsconnection, are only used for administrative purposes. Without the consent of the subscriber or court order, such information is not disclosed for other purposes or given to third parties.
Article 11 Emergencies
11.1 In emergency cases Newsconnection is entitled to make changes or other (temporary) measures at that time necessary to continue the service of Newsconnection. The subscriber will be informed as soon as possible.
11.2 Newsconnection is not liable for any damages or costs of the directory resulting from the measures referred to in paragraph 1 of this article. If such measures are taken, the subscriber is not entitled unilaterally to shirk its obligations.
Article 12 Force Majeure
12.1 With respect to the agreement, force majeure involves anything that is considered as such in terms of law and jurisprudence.
12.2 If Newsconnection is unable to meet its obligations resulting from the agreement due to force majeure, it does not need to comply with them. In that case, the agreement is annulled.
Article 13 Liability
13.1 Newsconnection cannot be held liable for any other form of damages, including supplementary damages in any form whatsoever, indirect or consequential damages, or damages relating to a loss of turnover or profit.
13.2 Considering the large number of junctions on the Internet that involve human intervention, the use of local networks and wireless communication, it should be taken into account that any information obtained from or sent by the Internet can be accessed freely. Newsconnection is not liable for any form of damage caused by sending confidential or secret information. Newsconnection is not liable for any security or third-party misuse of stored data.
13.3 Should the connection of Newsconnection be interrupted for a longer period due to destruction, an interruption of lines or any other cause, then Newsconnection cannot be held liable for any form of damage, including any form of supplementary damages whatsoever, indirect or consequential damages, or damages resulting from a loss of turnover or profit. At all times, Newsconnection will do its utmost to restore the connection in cooperation with the supplier.
13.4 Newsconnection is not liable for any damage in the widest meaning of the word, unless this damage has been caused by gross guilt or bad intentions on the part of Newsconnection in particular, Newsconnection is not responsible for any damage relating to or resulting from: interruption of, or blocking access to the system or the Internet, a lack of security of stored customer data, acts by other customers or internet users, changes in dial-in numbers, the login procedure, the account, the E-mail address and IP addresses
13.5 The use of the Newsconnection service is entirely at one’s own risk.
Article 14 Confidentiality
14.1 Newsconnection and subscriber will never provide confidential information to other third parties without the written (including e-mail) consent of the other party. The passwords of the account will be considered confidential information and the subscriber is responsible for protecting the confidentiality of such passwords, and prevent their use by one third.
14.2 The Subscriber acknowledges and accepts that the information provided for the payment of the subscription can and may be checked and processed by the companies who process the payments to check the creditability of the customer and to process the payment.
Article 15 Final Provisions
15.1 For all claims of the subscriber to Newsconnection, a limitation period of one year after the claim counts.
15.2 The relationship between the subscriber and Newsconnection is Dutch law. Disputes between the subscriber and Newsconnection is brought before the competent Dutch court, unless legislation or international treaties binding otherwise.
